EU AI Act Compliance Challenges for Eastern European Firms
The EU AI Act entered into force in 2024, with full enforcement provisions kicking in through 2025 and 2026. For Eastern European tech companies — particularly those in Romania, Poland, Bulgaria, and the Baltics — the compliance landscape presents challenges that differ meaningfully from what Western European firms face. Smaller budgets, thinner legal resources, and heavy dependence on outsourcing contracts that may or may not assign compliance responsibilities clearly all create a distinct set of problems.
The Compliance Burden
The AI Act classifies AI systems by risk level: unacceptable risk (banned), high risk (heavily regulated), limited risk (transparency requirements), and minimal risk (largely unregulated). Most Eastern European tech companies building AI features will fall into the “high risk” or “limited risk” categories, depending on their application domain.
High-risk classification triggers substantial requirements: risk management systems, data governance practices, technical documentation, transparency provisions, human oversight mechanisms, and accuracy/robustness standards. The documentation burden alone is significant. A company deploying a high-risk AI system needs to maintain records of training data, model architecture decisions, testing procedures, and ongoing monitoring — all in formats that regulators can audit.
For a large Western European company with dedicated legal, compliance, and AI ethics teams, this is manageable. For a 50-person Romanian software company that has built an AI-powered feature for a client, the same requirements can consume a disproportionate share of available resources.
The cost of compliance is not trivial. Early estimates from the European Commission’s impact assessment suggested that bringing a high-risk AI system into compliance costs between €6,000 and €7,000 for SMEs using pre-built tools, but can reach €200,000-400,000 for companies that need to build compliance infrastructure from scratch. For Eastern European firms with lower revenue bases, these figures represent a larger proportional burden.
The Outsourcing Complication
A large percentage of Eastern European tech work is done under outsourcing or staff augmentation contracts for Western clients. This creates a murky compliance situation. When a Romanian development team builds an AI system under contract for a German client, who’s responsible for AI Act compliance — the developer or the deployer?
The Act distinguishes between “providers” (who develop AI systems) and “deployers” (who use them in their operations). Both have obligations, but the provider bears the heaviest burden for high-risk systems. In a typical outsourcing arrangement, the contractual allocation of these roles is often ambiguous.
Many existing outsourcing contracts pre-date the AI Act and don’t address AI-specific compliance. Who conducts the conformity assessment? Who maintains the technical documentation? Who registers the system in the EU database? If the contract is silent, disputes are inevitable — and the Eastern European subcontractor is usually in the weaker negotiating position.
Forward-thinking companies are renegotiating contracts to clarify these responsibilities. This involves not just legal language but practical questions: does the outsourcing firm have the expertise to conduct conformity assessments? Can they implement the required quality management systems? Do they have access to the training data documentation they’d need to demonstrate compliance?
The Regulatory Capacity Question
Each EU member state must designate national authorities to oversee AI Act enforcement. In Western Europe, countries with established data protection authorities (like Germany’s state-level DPAs or France’s CNIL) have institutional infrastructure to build upon. Eastern European regulators face a different starting point.
Romania’s data protection authority, ANSPDCP, is already stretched thin enforcing GDPR with limited staff and budget. Adding AI Act oversight to its responsibilities without proportional funding increases risks inconsistent enforcement. Similar situations exist in Bulgaria, Croatia, and other Eastern European member states.
This creates a paradox: companies in these countries may face lighter enforcement in the short term (because regulators lack capacity), but could face severe penalties later when enforcement catches up. Building compliance now is prudent even if enforcement is initially lax.
There’s also the cross-border dimension. An AI system developed in Romania for a French client and deployed in Germany potentially triggers oversight from multiple national authorities. Navigating this multi-jurisdictional complexity requires legal expertise that many Eastern European firms don’t have in-house.
Specific Technical Challenges
Beyond legal and organizational challenges, several technical compliance requirements present particular difficulties.
Data governance. The AI Act requires that training data for high-risk systems meets quality criteria and that data processing is documented. Eastern European companies, particularly those in outsourcing, often don’t control the training data — their clients provide it, sometimes without clear documentation of its provenance, biases, or quality characteristics. Complying with data governance requirements when you don’t own the data is structurally difficult.
Bias testing. High-risk systems must be evaluated for bias across protected characteristics. This requires both technical capability (implementing fairness metrics, running demographic analyses) and contextual knowledge (understanding which biases are relevant in specific application domains). The bias testing requirements are particularly challenging for systems deployed across multiple EU markets, where demographic composition and discrimination concerns differ.
Monitoring and reporting. Post-deployment monitoring is required for high-risk systems. This means maintaining infrastructure for tracking system performance, logging decisions, and detecting drift or degradation. For small companies that deploy systems and move on to the next project, ongoing monitoring represents a perpetual operational cost.
What Eastern European Companies Should Do
Practical steps for compliance, roughly in priority order:
Classify your AI systems. Before anything else, determine which risk category applies. Many AI features fall into “limited risk” or even “minimal risk” categories, where compliance requirements are much lighter. Don’t assume everything is “high risk” — the Act’s definitions are specific.
Review contracts. For outsourcing companies, audit existing contracts for AI Act compliance allocation. Renegotiate where necessary. Be explicit about who’s the provider, who’s the deployer, and who bears which compliance obligations.
Build documentation habits. Even before full enforcement, start documenting model development processes, training data provenance, and testing procedures. Retrofitting documentation is much harder than building it as you go.
Invest in expertise. At minimum, someone in the organization needs to understand the AI Act’s requirements in detail. This might be a dedicated hire, an external advisor, or participation in industry groups that share compliance knowledge. Watch for guidance. The European AI Office is publishing guidance documents, standards, and codes of practice throughout 2026. These will clarify ambiguities in the Act and provide practical frameworks for compliance. Following these publications is essential.
The AI Act isn’t going away, and compliance isn’t optional for companies operating in or serving the EU market. Eastern European firms that invest in compliance now will have an advantage over those that wait and are forced to catch up under pressure.
